A nominee arrangement can survive for years on spoken promises and private understandings. One signature is enough to push it into criminal territory. In Thailand, that signature has a name, the ThorDor 16 form.

What the ThorDor 16 Is

The ThorDor 16 is a written declaration, made under oath before the land office official at the moment of a property transaction. The form is signed by the buyer and, where needed, by the other parties to the deal. It attests to the facts that decide whether the acquisition is lawful: that you are buying for yourself and not for a third party, where the funds come from, and that no foreigner stands behind the purchase as the real buyer.

This is the moment when what had been only words and intentions becomes an official written record. The official does not simply note an oral answer, he collects a formal declaration, dated and signed, added to the file. It is also the instrument that locks the declarant's position. Once the declaration is signed, his version of the facts cannot be rewritten without contradicting itself.

The Moment Words Become Evidence

Before that signature, a nominee arrangement lives in conversations, side agreements, informal understandings. Everything in it is deniable. Nothing is fixed. That vagueness is precisely what held these structures together.

The ThorDor 16 changes register. The declarant commits in writing, under oath, before a public officer. What was deniable becomes a signed statement that can be produced, archived and cross-checked later. The form is the hinge between the informal arrangement and legal ground. It does not create the structure, it fixes the official version of it, the one that will bind its author.

Why a Lie Becomes a Crime

If the declaration is true, the ThorDor 16 is a formality. If it is false, it becomes an offense in its own right. Making a false statement to a public official and causing a false entry in an official document are offenses under the Criminal Code, separate from the property offense itself. They stack on top of it.

The consequence is severe for a nominee structure. To reach registration, you have to go through the form. And to get through the form, someone has to lie, usually the Thai holder who swears he is buying for himself. That lie creates a second criminal exposure, independent of the property question, which falls first on the person who signs, then on those who organized the operation. The questioning described in step 4 of the procedure is the moment the declarant takes on criminal liability.

Take a common case. A Thai national agrees to be registered as the buyer to do a favor for a foreign friend, sometimes for a discreet fee. On registration day, he swears on the ThorDor 16 that he is buying the land for himself, with his own funds. He believes he is doing a harmless favor. In reality, he has just committed a criminal offense, on top of taking part in illegal landholding. The day data cross-checking shows the money came from abroad and that the foreigner occupies the property, his signed declaration turns against him, and he answers alone, first.

What a False Declaration Triggers

A false declaration does not stay isolated. It feeds the nominee file by providing documented proof of intent to conceal. It personally exposes the Thai signatory. And it reaches the facilitators, the people who built the structure, agents and advisers included, because enforcement targets the organizers too.

The danger does not fade once the signature is obtained. The declaration is then compared against the money flows, the contracts and the real use of the land, the very logic of control in fact. A false declaration holds as long as no one cross-references the data. It collapses the moment they do, and that cross-checking now takes a few days between administrations.

One detail makes this form especially treacherous. It is signed once, but it does not disappear. It stays in the file for years, open to review long after the sale. The day data analysis catches up with an old transaction, the document is still there, intact, ready to serve as evidence. Time does not erase it, it makes it more dangerous.

What This Changes for the Foreign Investor

The ThorDor 16 threatens only one category of people, those who have to lie on it. In the model THEVA defends, no one has a false declaration to sign, because there is nothing to hide.

The land belongs to a genuinely Thai entity, which declares what it is, a Thai-owned property, Thai in capital and in control. The foreign investor does not swear that he is buying land for himself through a stand-in. He declares, in the open, the rights he actually holds, a registered lease and a superficies right on his villa. The declaration and the reality say exactly the same thing. He signs the ThorDor 16 the way you sign any honest document, with nothing to fear from a future cross-check, because every line will hold up under review.

That is the whole difference between enduring the form and filling it in calmly. The person who conceals holds his breath as he signs. The person who holds transparent rights signs without a second thought.

Final Thoughts

The ThorDor 16 is a test of truth. For the honest owner, it is one more formality in an already solid file. For the nominee, it is the moment the structure becomes an offense written on paper, with a signature at the bottom.

For the serious investor, there is more good news here. A market that asks everyone to declare the truth under oath mechanically removes those who cannot, the fragile structures that long fed distrust of the country. The declaration only frightens the person with something to hide.

Everything is decided before the signature. A well-built acquisition makes the ThorDor 16 harmless, because the truth declared under oath is enough on its own. For the investor who holds transparent rights, a registered lease and a superficies right, the form simply records what already is.
